General
If you create an account on the Service, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account
Customer Data
Customer Data will be and will remain your property. “Customer Data” means any profile information, data, and other content or information provided by you, directly or indirectly, to MarketSurvey in connection with your use of the Service, including without limitation such data, content, and information related to your business. MarketSurvey shall only use Customer Data in accordance with MarketSurvey’ Privacy Policy. For the avoidance of doubt, this includes without limitation, using Customer Data in aggregate form to create reports, provide and improve the Service, and provide better functionality to our customers.
If you remove your data (by deleting a survey, un-publishing a survey, deleting a response, downgrading an account, etc.) or cancel your account, the system will remove your data permanently from the primary database servers immediately.
On a nightly basis, we create a backup of all data in our system, which is retained for 7 days, after which it will be removed permanently from all our systems. This backup is for use by Yolo9 Internet Solutions Pvt Ltd. only in the case of disaster recovery or to maintain business operations in the case of an emergency.
We will not accommodate requests for restoring data from our backup systems unless there is data loss due to a system or hardware failure on our part. No Exceptions.
Use of your Personal Information
We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions. It is a company policy that our customer databases remain confidential and private. We have not, will not, and won't ever sell names to "spammers" or other parties who would like to use our databases to advertise or solicit their products or services. Your private information is safe with us.
Termination
MarketSurvey may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your MarketSurvey account (if you have one), you may simply discontinue using the Service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Prohibited Uses
You may use our site and Services only for lawful purposes to these Terms of Use, and only for the benefit of your relationship with Yolo9 Internet solutions Pvt Ltd You may not use our site or Services in any manner that:
breaches any applicable local, national or international law or regulation;
in any way, is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
harms or attempts to harm minors in any way;
will reproduce, duplicate, copy, reverse-engineer, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission of Yolo9 Internet Solutions Pvt Ltd.
will abuse either verbally, physically, written or other abuse (including threats of abuse or retribution) of any Yolo9 Internet Solutions Pvt Ltd. customer, employee, member, or officer;
infringes on the rights of another in any manner.
Ownership Of Website Account And Security
You are responsible for maintaining the security of Your Content and MarketSurvey Account, and You are fully responsible for all activities that occur under the account and any other actions taken in connection with the MarketSurvey Account, including those of Your Users. You agree to immediately notify MarketSurvey of any unauthorized uses of the Account or any other breaches of security. MarketSurvey cannot and will not be liable for any loss or damage from Your failure to comply with this security obligation. You acknowledge and agree that under no circumstances will the Vendor be liable, in any way, for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.
